These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Customer,” “you,” or “your”) and Zach Weaver DBA Barhop Design Quincy (“Barhop Design Quincy,” “we,” “us,” or “our”), governing your access to and use of the Barhop Builder website platform (the “Service”), including all related hosting, tools, templates, and content made available through barhopdesignquincy.com.

By subscribing to or using our Service, you agree to these Terms. If you do not agree, you may not use the Service.

1. Description of Service

Barhop Builder is a subscription-based website platform that allows small businesses to build, customize, and host their own websites using pre-designed templates created and maintained by Barhop Design Quincy.
Each subscription includes access to a selected website template, hosting services, and access to editing tools that allow you to personalize your site with your own text, images, and other materials.

2. Account Registration

To access and use the Service, you may be required to create an account. You agree to provide accurate, current, and complete information and to maintain and promptly update such information as needed.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3. User Content

You are solely responsible for any content (including text, images, graphics, and media) that you upload, post, or otherwise make available through the Service (“User Content”).

By uploading or posting User Content, you represent and warrant that:

  • You own or have the necessary rights to use the content; and

  • Your content does not violate any law, infringe on the rights of others, or contain adult, graphic, illegal, or copyrighted material without authorization.

Barhop Design Quincy reserves the right to remove or suspend any content or website that, in our sole discretion, violates these Terms or applicable law.

4. Ownership and Intellectual Property

All templates, software, code, designs, and materials provided as part of the Service remain the exclusive property of Barhop Design Quincy and are protected by copyright and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the provided templates and tools solely for your business website while your subscription is active.

All User Content that you upload remains your property. Barhop Design Quincy does not claim ownership of your original content.

5. Payments and Billing

Barhop Builder is offered under two subscription plans:

  • Monthly Plan: $59.99 per month (non-refundable)

  • Yearly Plan: $599.99 per year (eligible for refund only if cancelled within 10 days of purchase, in writing)

All payments are processed securely through Stripe. Subscriptions automatically renew at the end of each billing period unless cancelled prior to renewal.
Refunds, when applicable, will be issued through Stripe in accordance with our Return and Refund Policy.

6. Cancellation and Termination

You may cancel your subscription at any time. When you cancel, your website will remain active until the end of your current billing period, after which it will be deactivated.

Barhop Design Quincy reserves the right to suspend or terminate your access to the Service, with or without notice, if we believe you have violated these Terms, failed to make required payments, or engaged in unlawful or abusive conduct.

Upon termination, your license to use Barhop Builder and its templates will immediately cease.

7. Limitation of Liability

To the fullest extent permitted by law, Barhop Design Quincy, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the Service, including but not limited to loss of profits, data, or business opportunities.

We make no guarantees that the Service will be uninterrupted or error-free and are not responsible for any downtime, loss of data, or unauthorized access to your website.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available,” without any warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles.
Any disputes arising under or relating to these Terms shall be resolved in the state or federal courts located in Adams County, Illinois, and you consent to the exclusive jurisdiction of those courts.

10. Modifications to the Service or Terms

Barhop Design Quincy reserves the right to modify or discontinue the Service (in whole or in part) at any time, and to update these Terms as necessary.
Any changes to these Terms will be posted on barhopdesignquincy.com with an updated effective date. Continued use of the Service after any such updates constitutes acceptance of the new Terms.
